Acceptance of terms

By accessing or using Grounds of Judgment ("the Platform"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Platform.

These Terms constitute a legal agreement between you and the operator of Grounds of Judgment. We reserve the right to modify these Terms at any time. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.

Description of service

Grounds of Judgment is a Caribbean legal research platform that provides searchable access to judicial decisions, statutes, and subsidiary legislation from jurisdictions including Jamaica, Barbados, Trinidad and Tobago, the Caribbean Court of Justice, and the Judicial Committee of the Privy Council.

The Platform is provided for informational and research purposes only. Nothing on the Platform constitutes legal advice. You should consult a qualified legal practitioner for advice specific to your circumstances.

Account registration

Certain features of the Platform require you to create an account. You must provide accurate, complete, and current information at registration and keep your account details up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at legal@askgoj.com if you suspect unauthorised access.

Accounts are personal and non-transferable. Sharing account credentials with other individuals is not permitted.

Permitted use

Subject to these Terms and your active subscription (where applicable), you may access the Platform to search, read, and download legal documents for lawful research, professional practice, academic study, or personal legal education.

You must not:

(a) systematically scrape, crawl, or harvest content from the Platform in bulk without our written consent;

(b) resell, sublicense, or redistribute Platform content or access as a commercial product or service;

(c) use automated tools to access the Platform in a manner that could damage, disable, or impair it;

(d) upload, transmit, or attempt to introduce malicious code, viruses, or other harmful material;

(e) impersonate any person, entity, or court; or

(f) use the Platform in any way that violates applicable law or regulation.

Intellectual property

Primary legal texts — statutes, subsidiary legislation, and judicial decisions — are public domain materials in the jurisdictions we cover. We do not assert copyright over those texts.

Our compilation, database structure, search indexes, annotations, summaries, and Platform software are proprietary to Grounds of Judgment and protected by copyright and database rights. You may not reproduce, copy, or redistribute these elements without our prior written consent.

Any AI-generated summaries or research notes generated through the Platform are for your personal use only and may not be published or redistributed without attribution to the Platform.

Disclaimer of warranties

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We make reasonable efforts to ensure the accuracy and currency of content on the Platform, but we do not warrant that:

(a) any document on the Platform reflects the current law in force;

(b) the Platform will be available at all times without interruption;

(c) search results will be complete or exhaustive; or

(d) AI-assisted research outputs will be accurate or free from error.

Users conducting professional legal research should verify all citations against authoritative official sources before reliance.

Limitation of liability

To the fullest extent permitted by law, Grounds of Judgment and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, even if advised of the possibility of such damages.

Our total liability to you for any claim arising in connection with these Terms or the Platform shall not exceed the amount you paid for the Platform in the twelve months preceding the claim.

Subscription and payments

Paid subscriptions are billed in advance on a monthly or annual basis. All fees are stated in US dollars unless otherwise indicated.

Subscriptions renew automatically unless cancelled before the renewal date. You may cancel at any time through your account settings; the cancellation takes effect at the end of the current billing period.

We reserve the right to change subscription prices with 30 days' prior notice. Continued use after the effective date of a price change constitutes acceptance of the new price.

We do not offer refunds for partial billing periods except where required by applicable consumer protection law.

Termination

We may suspend or terminate your account at any time if you breach these Terms, if we reasonably suspect fraudulent or abusive use, or if we discontinue the Platform.

Upon termination, your right to access the Platform ceases immediately. We may delete your account data in accordance with our Privacy Policy.

Governing law

These Terms are governed by and construed in accordance with the laws of Jamaica, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Jamaica.
